Payment demands in Italy: what to send and what to agree
Another reminder has brought another promise. Before accepting “next month”, put the amount, the payment dates and the consequences of a missed instalment into a clear proposal. A demand should explain the debt; a repayment agreement should explain exactly what changes.

Decide what the communication needs to achieve
For a creditor abroad pursuing an Italian customer, a request for payment may need to do more than restart a conversation. It may need to identify the claim formally, deal with an objection or prepare the ground for a negotiated payment. Check the applicable law and any contractual notice provisions before relying on a standard letter.
Resolve an administrative delay
Confirm the invoice was received and whether a payment is already being processed.
State the claim clearly
Identify the parties, amount, basis and requested payment, with evidence of delivery.
Record the negotiated terms
Set out payment dates, any concessions and the consequences of non-payment.
Under Italian law, Article 1219 of the Civil Code provides for a written demand or request to place a debtor in default, while also identifying cases where a demand is unnecessary. The statutory rule on default (messa in mora) does not mean every routine reminder has the same legal effect.
Make the payment demand easy to check
Reconcile the figures before sending the letter. The invoice and payment schedule should account for credits and part payments, rather than repeating an old invoice total.
- Creditor and debtorCreditore / debitore
- The correct legal names, relevant addresses and the capacity of anyone acting for another party.
- Basis of the claimContratto / ordine / prestazione
- The agreement, what was supplied, invoice references and why payment is now due.
- Amount requestedCapitale / interessi / spese
- Principal, interest and claimed costs shown separately, with the basis and period for any additions.
- Payment and responseModalità di pagamento / termine
- Payment instructions, a clear requested date and a contact for any substantive objection.
- Supporting materialDocumenti allegati
- Relevant documents identified by name or reference, with a copy of the final communication retained.
Use factual language. Do not present an unissued court order as an existing order or imply that assets can immediately be seized simply because the demand is unpaid. A payment demand is not itself an enforceable judgment.
How many days should the debtor be given?
There is no single response period to copy into every payment demand. The contract, purpose of the notice, applicable rules and circumstances matter. A notice intended to terminate a contract can have different requirements from a request for payment. Have the wording checked before adding termination language or treating a chosen date as a statutory deadline.
Can interest and recovery costs be included?
Where qualifying commercial late-payment rules apply, interest and recovery-cost compensation may be available. Identify the applicable regime, rate, period and any contractual terms before adding a figure. The rules are not interchangeable with those for consumer debts; the EU’s business late-payment guidance explains the starting conditions.
Keep evidence of what was sent and where it arrived
Confirm the recipient’s identity and address. Preserve the final message, attachments and delivery evidence together. A sent-mail entry or screenshot alone may leave unanswered whether the right person received the complete communication.
Italian certified email, PEC, can provide evidence of transmission and delivery when used within the certified system. As AgID explains, PEC-to-PEC transmission produces receipts and has the legal value of registered post with acknowledgment of receipt. Sending an ordinary email to a PEC address does not turn it into a PEC-to-PEC transmission.
If you are abroad and do not have PEC, discuss an appropriate delivery method with the person handling the demand. An appropriate delivery method can be agreed without requiring you to buy a PEC mailbox.
Use the reply to choose the next step
- Payment claimedMatch it to the account
Check receipt, currency, reference and allocation before closing the file.
- An objectionIdentify what is disputed
Separate complaints about the work, price, due date or legal responsibility.
- More time requestedAsk for a concrete proposal
Dates, amounts and the reason the proposed schedule is realistic.
No reply is not an admission that the claim is correct. Keep the silence and delivery record in context when assessing the available recovery procedures.
If the customer disputes delivery or performance, review the records of goods supplied or work completed before repeating the demand unchanged. Address the actual objection, including any supporting material the debtor provides.
Turn a repayment proposal into specific terms
“We will pay in instalments” leaves too much open. Establish who is agreeing, whether that person has authority, which debt the arrangement covers and whether the amount is admitted or remains disputed.
- Amount and scope
- The invoices covered, remaining principal, treatment of interest and costs, and any claims excluded from the arrangement.
- Dates and amounts
- Each payment date and instalment amount, currency, destination and allocation.
- A missed payment
- Any notice or opportunity to remedy, whether the remaining sum becomes due, and what further action may be taken.
- Existing rights
- Whether the agreement changes or replaces the original obligation, and how any guarantees or security are affected.
Example: €6,000 offered in three instalments
Illustrative example. The debtor proposes three payments of €2,000. The first arrives, the second does not.
A schedule containing only three dates may not answer whether the entire remaining balance is immediately due, whether a discount has been lost or whether another notice is required. Those consequences should be addressed when the agreement is drafted, not assumed after the missed payment.
A signed repayment plan is not automatically a document that permits immediate enforcement. If enforceability is important, have the required form and legal route assessed before signing.
Know when a discount or release takes effect
A debtor may offer a smaller sum to settle the whole claim. Distinguish a part payment from payment accepted in final settlement, and specify whether any release takes effect on signing or only after the agreed funds are received. Have the consequences of late or incomplete payment addressed expressly.
Do not rely on a generic “without prejudice” label as a universal guarantee that a proposal cannot be used in proceedings. The applicable rules, sender and context need to be considered.
Negotiations should not replace a deadline check
Where Italian law governs limitation, Article 2943 of the Civil Code recognises acts placing the debtor in default as a way to interrupt prescription. Whether a particular communication qualifies depends on its content and the relevant circumstances. See the rule on interruption of prescription.
Have the limitation period, earlier demands and proposed agreement checked. Check which action, if any, has preserved the relevant rights; a reminder, conversation or draft plan may be insufficient. If court papers or an insolvency notice arrive, raise them immediately.
For an initial enquiry, use the contact form with the amount, debtor’s location, due date and current stage. Mention any demand already sent, response received or proposed payment plan. Wait for instructions before sending confidential documents; any paid assessment is quoted before work begins.
Enquire about a payment demand ↗General information, not a ready-to-send demand or settlement agreement. An enquiry does not create an engagement or mean that responsibility for a deadline has been accepted.
