Buying property in Italy remotely: power of attorney, translations and signing

You can often arrange an Italian property purchase without travelling to the final signing, by appointing someone to act for you. The practical question is whether that person has the right authority, in a form the Italian notary can use, before the agreed completion date. Start with the receiving notary's requirements, before booking an appointment abroad.

Agree the signing route with the Italian notary first

Explain where you live, your nationality, the property involved and whether you will attend any stage in person. Ask what identity, tax-code, marital-status and other documents are needed. Where acquisition eligibility or reciprocity needs checking, have the notary resolve it for your circumstances; a representative does not remove requirements that apply to the buyer.

Two practical routes to the final deed
Attend in Italy

You sign the deed

Agree the appointment, identification and language arrangements. Allow time to review the draft before travelling.

Act through a representative

An attorney-in-fact signs

A properly authorised representative signs within the powers you grant. Agree the wording and execution formalities of the power of attorney beforehand.

The Ministry of Foreign Affairs explains that a power of attorney, or procura, allows another person to act in your name, with effects attributable to you. “Attorney-in-fact” describes that representative role; the person appointed is not necessarily a lawyer.

Give the representative the powers needed for this purchase

A transaction-specific procura speciale is often the appropriate starting point for a defined purchase. Have the Italian notary prepare or approve the draft, then coordinate it with the professional who will receive your signature abroad. A general template may omit something essential or confer more discretion than you intended.

Review the proposed authority
People and property
Identify you, the representative and the property or rights being acquired, including relevant ancillary areas.
Price and permitted changes
Specify the agreed price or limits and which changes, if any, the representative may accept.
Payments and declarations
Check powers concerning payment arrangements, receipts and declarations required for the deed. Give accurate information for any declarations made on your behalf.
Financing and additional acts
If borrowing, confirm the lender's requirements and whether separate or additional authority is needed for the mortgage and related documents.
Duration and delegation
Discuss when the authority ends, whether substitution is permitted and how any later change or revocation should be communicated.

Keep the representative's instructions consistent with the obligations in the preliminary contract. Check any potential conflict of interest before appointing a person involved on the other side of the transaction.

Example: the completion draft changes after you sign the procura

Illustrative example. A buyer authorises a purchase on specified terms. Before completion, the seller proposes a revised price or a different arrangement for possession.

Send the revised terms to the Italian notary and ask whether the existing authority covers them. Have any limitation in the formal power of attorney addressed through the required formalities, rather than relying on a separate email saying “I agree”. A revised document and further formalities may be needed.

Confirm the formalities for the country where you will sign

The route depends on the country, the document and any applicable international arrangements. Consular notarial services may be available to Italian citizens, subject to the office's competence and local arrangements. Alternatively, a foreign notary or other appropriately authorised professional may be involved. Confirm availability and requirements with the relevant office rather than assuming every consulate offers the same service.

For example, the Italian Consulate in London asks applicants for a draft prepared by an Italian notary and explains the local-notary route in its property power-of-attorney instructions. Those are instructions for that jurisdiction, not a universal procedure.

Coordinate the document before arranging the signature
  1. DraftReceiving notary checks the text

Confirm the powers, personal details, property information and required form.

  2. ExecutionSign through the agreed route

Confirm the local professional's requirements, identification and appointment arrangements.

  3. Use in ItalyComplete the agreed formalities

Arrange any authentication, translation and delivery required; obtain confirmation that the Italian notary has an acceptable document.

Where the Apostille Convention applies, an apostille replaces traditional legalisation for qualifying public documents. In other situations, legalisation may be required, or an exemption may apply. The HCCH Apostille Section identifies the Convention and competent authorities; the Ministry provides guidance on translation and legalisation.

Ask whether the original, a certified copy or an accepted electronic document must be delivered, and by when. A scan may help with advance review but should not be assumed to replace the document required for signing.

Separate understanding the contract from formal translation requirements

You need to understand what you authorise and what will be signed. Request the draft and an explanation in a language you understand before approving either. Translation for your review and translation required for use of a foreign document are related but distinct tasks.

Tell the notary early if you will attend but do not understand Italian. Ask which language arrangements, translation and interpreter formalities apply. Arrange the required formal language support; an informal translation by a friend or an English summary may be insufficient.

The Notariato's study on foreign-language attachments explains why the form and use of the document matter. Agree who prepares the translation and how it is certified or otherwise accepted before paying for it.

Does a bilingual document remove the need for checks?

No. Confirm that both versions reflect the same powers and terms, and ask how they will be treated in the transaction. If a draft changes after translation, identify the final approved version and update the translation where needed. A second language does not itself resolve authentication or execution requirements.

Prepare the documents and money on the same timetable

Remote signing does not replace property due diligence. Decide who will report unresolved issues to you and who has authority to approve a change. A representative attending the deed should not be expected to discover, on the day, whether the home matches the agreed condition.

Before confirming the completion appointment
Documents accepted
Confirm that the notary has reviewed the executed procura and required supporting records, with any outstanding items clearly identified.
Final terms approved
Reconcile the deed draft with the agreement, payments already made and any agreed amendments.
Funds available
Confirm recipients, payment method, bank processing time and any lender conditions. Verify changed payment instructions through an independently established contact channel.
Practical handover
Identify who checks possession, collects keys and records delivery of keys and possession. Arrange delivery of the signed documents and payment evidence to you.

Include translation, authentication, courier and representation costs in the professional-fee budget. Avoid booking a completion date on the assumption that appointments, authentication and delivery will all be immediate.

Start with the documents and the next deadline

For a remote purchase, specify whether you need review of the contract, coordination of documents or representation under a separately agreed authority. An enquiry or a legal-review engagement does not itself grant power to sign for you.

Use the contact form with the property's location, your country of residence, whether anything has been signed or paid, and the proposed completion date. Describe the documents available and wait for instructions before sending confidential material. Any paid assessment is quoted before work begins.
