Debt collection in Italy: options for a foreign creditor
An unpaid invoice does not always call for the same response. Start with what the customer says, then assess the evidence, costs and prospects of recovery.

What is stopping payment?
“We need more time.”
Assess a written repayment proposal: amounts, dates and what happens if a payment is missed.
“The work was defective.”
Examine the complaint alongside the contract and evidence of delivery. A reminder alone will not resolve the dispute.
Emails go unanswered.
Check the debtor’s identity, status and supporting documents before choosing a formal demand or proceedings.
These are starting points for assessment, not automatic legal outcomes.
What can an Italian lawyer do?
- Demand for paymentSets out the claim and invites payment or a response.
- Court proceedings, if appropriateA decreto ingiuntivo may be available where the legal conditions and written evidence support it. The debtor can oppose it.
- Enforcement, if neededAn enforceable title may be used to pursue assets. An order does not guarantee that money can be recovered.
Each stage needs its own assessment of costs and prospects. This simplified route is not the procedure for every claim.
What will debt recovery cost?
The initial assessment and demand should be distinguished from court fees, litigation and possible enforcement. A useful estimate states what is included at each stage; it should not treat a letter and a completed recovery as the same service.
The amount owed is only one consideration. A disputed supply, missing evidence or concerns about the debtor’s assets may change whether further spending is worthwhile.
Documents for an assessment
- Contract or accepted orderWho owes the money, and on what terms?
- Invoice and payment recordWhat fell due, when, and how much remains unpaid?
- Delivery evidence and correspondenceWas the work accepted? Is there a complaint or a promise to pay?
Mention any existing judgment or jurisdiction clause. An international claim requires a check of the competent court.
