Italian car accident settlement offers: what to check before signing

The email gives you a figure and asks for a signature. Before deciding whether the figure is enough, establish what it pays for—and what the signature would bring to an end. The offer and the proposed release need to be read together.

Put the total aside for a moment

Find the accident reference, the person being compensated and the losses included. For repair assessments and workshop evidence, see documenting vehicle damage. A letter about repairs may concern only the vehicle; another may seek to settle the whole claim. Do not infer the scope from the subject line or from a conversation with the claims handler. Any contribution towards legal fees and expenses also needs to be reconciled with your engagement agreement.

An illustrative offer · four places to look
1 · “Compensation for injury”
Which recovery periods and permanent effects have been assessed? Ask for the medical basis and the valuation framework used.
2 · “Expenses included”
Which invoices, care costs and earnings losses are included? A single label does not show whether an item was accepted, reduced or omitted.
3 · “Less deductions”
Identify any reduction for responsibility and any previous payments. Check that the same payment has not been deducted twice.
4 · “Full and final settlement”
Read the exact scope of the proposed release. Does it concern one specified loss or all claims arising from the accident?

These labels are invented examples, not a real insurer’s offer or a valuation. For the different heads of loss, use the guide to injuries, expenses and lost earnings.

There is a deduction for shared responsibility. What should I ask?

Ask what percentage has been applied, which losses it affects and which evidence supports the proposed allocation of responsibility. Compare the explanation with the accident form, photographs and other available evidence. Keep the disagreement about responsibility separate from a disagreement about the value of an injury: they may both affect the total, but for different reasons.

Read the words immediately above the signature

Look for the parties named, the accident identified, the claims covered and any reservation of outstanding matters. If the document is in Italian, obtain an explanation you understand before agreeing to it. The operative wording matters more than the title “receipt” or “release”.

Three questions for the proposed release
  1. ScopeWhich losses?

Repairs only, injuries, expenses, earnings—or a broader settlement?

  2. PeopleWhose claims?

Check the claimant and the people or companies being released.

  3. Outstanding mattersWhat stays open?

If something is reserved, identify it expressly and check the agreed wording.

Can I just add “without prejudice” beside my signature?

Do not rely on a phrase added by you to resolve a conflicting settlement document. If you intend to accept only a payment on account, or to settle only vehicle damage, have that intention reflected clearly in the terms agreed with the other party. The effect of a qualification depends on the document and surrounding circumstances.

A payment on account and a final settlement are different questions

Keep the offer letter, any acceptance, the payment reference and the proposed release together. An amount arriving in your account does not explain, on its own, every term on which the parties have dealt.

Article 148 of the Italian Insurance Code distinguishes acceptance of an offer from situations in which the offer is not accepted or no response is received. It provides for payment of the offered amount in the latter situations too, with that payment credited towards the final assessment of the damage. That statutory mechanism should not be confused with signing a separate full settlement. See Article 148, paragraphs 6–8.

The applicable procedure and the correspondence need checking before deciding what a particular payment means. Do not assume either that every payment closes the case or that accepting and signing can never affect a further claim.

The insurer has already paid. What should I preserve?

Save the bank entry, the payment description, the offer and every document you signed or accepted electronically. Record whether any part of the amount had already been paid earlier. If you are unsure what was agreed, obtain a review of those documents before sending a new acceptance or signing another release.

If treatment is still continuing, identify the unresolved point

A pending appointment is not simply another receipt to collect. It may concern the recovery period, further treatment or a lasting effect that has not yet been assessed. State what is pending and why it matters to the proposed settlement. Resolve these uncertainties before signing: reopening a final agreement may not be possible.

If your care is now taking place abroad, see medical records and assessments from abroad. The question here is whether the available evidence supports a final decision, not whether treatment happened in Italy or elsewhere.

Make the next reply specific

  • Missing explanationIdentify the component you cannot follow and ask for its calculation or supporting assessment.
  • Missing evidenceName the report, invoice or earnings record that has not been considered, with its date.
  • Disputed releaseIdentify the wording that goes beyond the settlement you intend to make.
  • DatesDistinguish a requested reply date from the separate deadline for preserving your legal rights.

Where the statutory conditions are met, access to the insurer’s claim file can help you understand the assessment. The IVASS motor insurance FAQ explains when access becomes available and its procedural limits. Ask for the relevant documents rather than assuming that a request gives unrestricted access to other people’s medical information.

Keep the records organised using the accident evidence checklist. Negotiations and requests for clarification should not displace the separate check of insurer response times and claim deadlines.

Before asking for a review

Use the contact form to give the accident date, your country of residence, the date of the offer, any requested reply date and whether you have already signed or received payment. Keep the offer and release ready; wait for instructions before sending medical or identity documents.

General information, not an assessment of an individual offer. The legal effect of a payment or release depends on the applicable law and the documents. An enquiry does not create a professional engagement or mean that a deadline has been accepted.
