Car accident in Italy: claiming compensation from abroad
A practical guide to claiming compensation after a road accident in Italy: documents, insurance and the next steps from abroad.

First steps after returning home
An accident in Italy can leave you dealing with an insurer long after the journey home. Start with the evidence you already have: the accident form, photographs, medical records and correspondence.
If the insurer has issued a claim number, keep it. It identifies the file; it does not mean that responsibility or the amount of compensation has been agreed.
The documents worth taking home
Photographs and witness details are hardest to replace after leaving. For a missing police or hospital record, keep the authority’s name, date and reference: these are the starting points for requesting a copy.
- Accident statement CAI / CID · constatazione amichevole
- Keep: every page, signatures and any separate statement. Check: people, plates and vehicle roles are recorded correctly.
- Police accident report Verbale / rapporto di incidente
- Request from: the authority that attended. Keep the incident reference, place and date. Preserve the other evidence while requesting it.
- Emergency and hospital records Referto di pronto soccorso / cartella clinica
- Request from: the hospital’s records service. Keep examination reports and available imaging as well as the discharge note. Retain originals from both Italy and your home country.
- Photographs and witnesses Fotografie / testimoni
- Keep: original photographs of the scene and damage, witness names and reliable contact details. Record what each person actually saw. A passenger’s account should identify that person as a passenger.
- Expenses and claim correspondence Fatture / ricevute / numero di sinistro
- Keep: itemised bills, proof of payment, repair estimates and messages with insurers. Label what each expense relates to; a receipt alone may not explain why it resulted from the accident.
Already home? Use the Italian document names when asking for copies. Do not pay to translate the entire file before establishing what the recipient needs.
A passenger recorded as a witness: why it matters
Illustrative example. A passenger’s name appears only in the witness field of the CAI. The insurer queries whether that person was travelling in the vehicle.
Keep the original form unchanged. A separate explanation from the driver, together with relevant contemporaneous records, can support clarification. Read the explanation alongside the contemporaneous records.
Which insurer should receive the claim?
To identify the appropriate insurer, first note your country of residence and both vehicles’ registration countries. Also identify whether you were a driver, passenger, pedestrian or cyclist. The routes below are starting points, not an exhaustive choice: passengers and some drivers may have a different route.
Identify its insurer
Start with the insurance details on the accident documents. If they are missing, CONSAP’s Information Centre can help identify cover for an Italian vehicle.
Insurance information →Check the UCI route
For accidents caused in Italy by foreign-registered vehicles within its remit, UCI identifies the organisation handling the claim.
UCI: foreign vehicles in Italy →Check the Guarantee Fund
Claims within the Fund’s scope go to the designated insurer, with a copy to CONSAP. Cover and limits depend on the circumstances.
Designated insurers and conditions →What about passengers or an Italian rental car?
A passenger may have a claim against the insurer of the vehicle they travelled in, subject to the conditions of that procedure. A driver using an Italian rental car may qualify for direct compensation through that vehicle’s insurer. Neither route should be ruled in or out simply because the injured person lives abroad.
Medical assessments after returning home
Continue medically necessary treatment and keep the records from Italy and your home country together. A treating doctor’s clinical report and the medico-legal assessment for compensation serve different purposes.
- RECORDSWhat is already available?
Original treatment records, imaging and the course of recovery.
- ARRANGEMENTSWhich examination is needed?
Confirm the examiner, location and purpose with the claim handler.
- COSTSWhat needs approval?
Agree reports, translations and payment before commissioning work.
Do not assume that a local or video assessment will satisfy every request. If invited to an examination in Italy, discuss the arrangements before booking or declining. The guide to continuing a claim from abroad covers records, translations and assessment arrangements.
What affects the amount — and the time needed?
The injury assessment is one part of the claim. Responsibility, evidence and the applicable law also affect what can be recovered. Keep these losses separate when organising the file:
- Injury and its consequencesMedical findings, treatment history and evidence of effects on everyday life.
- Expenses and lost earningsMedical and care bills, payment records and evidence of income actually lost.
- Vehicle and other property damagePhotographs, estimates, inspection records and invoices. Arrange inspection before repairs where possible.
These are categories to examine, not automatic entitlements. A reliable final injury valuation may have to wait until recovery or stabilisation. Treatment and investigations should follow medical advice.
Notify promptly
Follow the reporting requirements of any relevant motor, rental or travel cover. Reporting an accident is not the same as submitting a complete compensation claim.
30 / 60 / 90 days
Under the ordinary Italian rules: 60 days for property damage, reduced to 30 with a jointly signed CAI; 90 for injury, once the complete request includes medical certification of recovery or stabilisation of the lasting effects. These periods do not run simply from the accident date. IVASS: offer deadlines →
Usually two years
Italian road-accident claims generally have a two-year limitation period. Exceptions and valid interruption can change the calculation. Do not wait for treatment or negotiations to finish before checking it.
The response deadline concerns an offer or a reasoned explanation, not a promise of final settlement. Different routes can have different rules. Keep proof of what was sent, to whom and when.
An offer has arrived. What should be checked?
Compare the offer breakdown with the losses claimed and the medical evidence. Check any deduction for shared responsibility and read the release before signing. Receiving money and agreeing a full and final settlement are not necessarily the same thing.
Ask the practice about the claim
Avv. Luca Valente offers out-of-court assistance after an accident in Italy, examining the documents and handling the claim within the agreed engagement. Correspondence is by email. Any court proceedings require a separate assessment and agreement.
In your first enquiry, give the date and place of the accident, your country of residence, whether there are injuries and whether an insurer has already responded. Mention the documents available; wait for instructions before sending medical records.
The practice first confirms whether it can consider the matter and what documents are needed. Any paid assessment is quoted before work begins. The engagement sets out legal fees and any separate costs, such as medical reports or translations; reimbursement by the insurer is not assumed.
