Legal fees after an accident in Italy: what to clarify
Before appointing a lawyer, you need to know what the work covers, what you may have to pay and when. A figure described as “legal fees” may leave out medical reports, translations or a later court case. Ask for the pieces to be shown separately.

Start with the work included in the price
An initial assessment, negotiations with an insurer and court proceedings are different assignments. A quote for one does not necessarily include the others. Identify the stage you are asking the lawyer to handle and what would bring that stage to an end.
The lawyer’s fee
Advice, preparation of the claim, correspondence and negotiations within the agreed scope.
Reports and other expenses
Medical expertise, translations, records and any other necessary external work.
Additional charges
Any applicable taxes, professional contributions, general expenses and payment dates.
Italian law requires written communication of the foreseeable cost, distinguishing the professional fee, expenses and other charges. The rule appears in Article 13(5) of Law 247/2012, as amended in 2017; see the published text of Article 13 (PDF).
Ask whether the amount is fixed for a defined stage, calculated by time or determined on another stated basis. If it is an estimate, identify its assumptions and how changes will be communicated. A useful estimate explains both the work and the circumstances that could increase the cost.
- Initial document review
- Which documents will be examined, what advice will be provided and whether further work needs a new agreement.
- Out-of-court claim
- Whether the quoted work includes preparing the request, responding to queries and reviewing an offer.
- Medical report or translation
- Who commissions it, who pays the provider and whether approval is needed before incurring the expense.
- If negotiations fail
- What is excluded, how the next stage is assessed and which new costs would require agreement.
Your fee agreement and the insurer’s contribution are separate
Ask what you owe under the engagement even if the insurer declines to reimburse legal expenses, disputes responsibility or makes no offer. An expectation of reimbursement should not be confused with a commitment that you will never pay anything yourself.
Where an offer includes a contribution towards legal expenses, ask how it will be credited against amounts already paid or still due. The settlement breakdown and release should make clear what is being paid and which claims are being closed.
Example: the insurer offers one combined amount
The letter gives a single total for compensation and costs, without separate figures. Ask for the allocation and a reconciliation with your fee agreement before deciding what the offer leaves you with. The headline amount alone does not answer that question.
This is an illustrative example, not a quotation or a prediction of recovery.
Does “no win, no fee” mean there can be no bill?
Do not rely on the label. Ask which expenses remain payable, what counts as success and what happens if the assignment ends early. Italian law regulates fee arrangements and prohibits agreements giving the lawyer a share of the subject matter of the dispute. A foreign marketing label is not a substitute for reviewing the actual terms; Article 13(3)–(4) is the starting point. This guide does not offer a particular success-based arrangement.
Check any legal expenses cover before commissioning work
A motor, travel, household or separate legal protection policy may be relevant, depending on its terms. Locate the policy that applied on the accident date and ask the insurer for a written coverage decision. Do not infer cover simply from having travel insurance.
- Territory and subject matterDoes the policy cover this type of accident in Italy and the assistance you are seeking?
- Limits and your contributionWhat financial limit, excess or exclusions apply to legal work, experts and translations?
- Notification and approvalWhat must be notified, when, and which expenses need advance authorisation?
- Appointment arrangementsCheck both the policy terms and any statutory right to choose your lawyer. Where Italian legal-expenses insurance rules apply, Article 174 protects that choice in the circumstances it covers, including judicial or administrative proceedings and conflicts of interest with the insurer. Freedom to choose does not by itself mean that every fee or expense will be reimbursed.
Keep the coverage decision with the engagement documents. If the policy insurer and the lawyer describe the payment arrangements differently, resolve that difference in writing before assuming that an invoice will be covered.
Medical expertise and translations need their own budget
Paying for treatment is different from commissioning a report to assess an injury for the claim. Establish the purpose of a proposed report, who will prepare it and its cost. Avoid commissioning overlapping reports without first explaining what already exists.
Similarly, do not translate the entire file just because it was issued abroad. Agree which records are needed and the required format. When coordinating medical records after returning home, keep the original documents alongside any translations.
What if court proceedings become necessary?
Ask for a separate assessment of the proposed proceedings, their scope and costs. Discuss court charges, experts and the risk of an adverse costs order, as well as the lawyer’s own fees. An out-of-court quote does not establish the budget or risks of litigation, and winning does not by itself guarantee that every sum spent will be recovered.
Before agreeing, get three answers in writing
- ScopeWhat am I appointing you to do?
The stage, deliverables and exclusions, including any separate court work.
- BudgetWhat could I have to pay?
The fee, additional charges, external costs and payment timetable.
- ChangesWhen do we review the agreement?
New work, increased costs, an offer, or the end of the assignment.
While discussing costs, identify any approaching deadline for protecting the claim. Sending an enquiry or requesting a quote does not mean that a lawyer has accepted responsibility for it.
For this practice, any paid assessment is quoted before work begins. Out-of-court assistance and any proposed court proceedings require an agreed scope. Use the contact form with the accident date, place, country of residence and current stage of the claim. Mention any offer, deadline or legal expenses policy; wait for instructions before sending medical records.
General information, not a fee quotation or a promise of reimbursement. An enquiry does not create a professional engagement or mean that a deadline has been accepted.
